18. DISPUTE RESOLUTION AND ARBITRATION

- Provide reasonable information about the dispute and your desired resolution

Agreement to Arbitrate:

Costs:
- Each party bears its own attorneys’ fees and costs unless arbitrator awards fees
- The complainant will pay AAA filing, administration, and arbitrator fees for claims under $10,000
- For claims over $10,000, fees are allocated according to AAA rules
- Arbitrator may award attorneys’ fees and costs to prevailing party if authorized by law
18.3 CLASS ACTION WAIVER
YOU AND BOLD VISIONARY ENTERPRISES DBA New Porch Ministries AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE ACTION.
This means:
- You may not participate in class actions against us
- You may not serve as class representative or class member
- Arbitrator may not consolidate multiple persons’ claims
- Arbitrator may award relief only in favor of individual party seeking relief
If class action waiver is found unenforceable:
- The arbitration agreement is void
- Dispute will proceed in court
- Class action will proceed according to applicable law
Opt-Out of Class Action Waiver:
- You may opt-out of class action waiver (but not arbitration) within 5 days of first accepting these Terms
